Mannatech just announced that the Securities and Exchanged commission has ruled that the direct sales company will not face civil action relating to a complaint filed against it as a result of dismissing its accountant last year.

The SEC announced in September of this year that it was launching an informal inquiry into the dismissal of Grant Thornton, the company’s public accountant. The SEC was looking into whether or not the dismissal of the accountants violated various federal laws. Apparently the firing came after Thornton demanded that Mannatech either remove its chairman and founder Sam Caster or find a new accountant. Mannatech chose the later, and promptly fired Thornton and hired a new accountant. While Mannatech did release a formal statement regarding the firing, they neglected to file the proper 8K within the required time frame.

In early September Mannatech was sent a Wells notice, which was merely an indication that they would look further into the company. The Wells notice gave the company a chance to defend itself to prevent further action.

Upon extensive review of the situation, Mannatech has been cleared of any wrongdoing and will not face any formal sanctions from the SEC.

Mannatech, Inc, a global developer of skin care products and dietary supplements has just announced the findings of a recent study it conducted of the company’s BounceBack capsules, saying that the study indicates that the supplement can significantly reduce sore muscles after overexertion.

The study, a randomized, double-blind, placebo controlled human crossover study, was conducted by Medicus Research LLC , a California based research organization. Mannatech was quick to note however, that while the Research facility is a well established one, the Food and Drug administration has not evaluated any of the findings or statements regarding the effectiveness of the supplements.

The study was presented last month at the annual International Society of Sports Nutrition Conference and Expo and was also published n the Journal of the International Society of Sports Nutrition.

The study, which the company says was specifically designed to assess the benefits of BounceBack on muscle soreness and muscle recovery, found that the product reduced overall muscle soreness after physical activity, reduced stiffness, and helped contribute to overall joint and cartilage health.

Dr. Robert Sinnott, senior vice president and chief science officer at Mannatech said, “Specifically, researchers concluded that BounceBack capsules resulted in a significant reduction in standardized measures of pain and tenderness post-eccentric exercise, even after engaging in significantly more activity in the two-day period prior to the exercise protocol.

Mannatech has been awarded over $700,000 dollars in attorneys fees as a result of a recent legal dispute with Glycoproducts International.

Judge Jeff Kaplan of the U.S. District Court of the Northern District of Texas order Glycoproducts to pay $773,347 in legal fees for the successful prosecution of its infringement claims for Mannatech’s Ambrotose products.

In July of 2008 a judge handed down a ruling that Glycobiotics infringed on two of Mannatech’s patents concerning Mannatech’s Ambrotose products. The case had been ongoing for almost 2 years, originally filed in March of 2006. As part of the ruling, Glycobiotics had to immediately stop producing and selling the products specified in the case as well as deliver said products to Mannatech directly for destruction.

“Mannatech has demonstrated that it will fight to protect its intellectual property. The Court’s award of more than $770,000 in attorneys’ fees, along with the Court’s previous entry of a final judgment and permanent injunction, is further notice to all interested parties that we will do what is necessary to support our products and our independent sales Associates in the field,” said Keith Clark, senior vice president and general counsel of Mannatech.

Mannatech has just launched its newest fat loss product, OsoLean. The new product, which comes in a powder form, is a whey protein supplement that is all natural and can be mixed with any food or beverage.

When Mannatech developed the OsoLean powder, they secured a patent on the process that involves separating a certain part of the whey protein call peptides, and concentrated them to increase their effectiveness in fighting fat. This, says the company is what separates their product from other whey proteins on the market.

We told you a month ago about the introduction of OsoLean at MannaQuest, 2008, the company’s annual convention. While distributors got a chance to test and try out the product ahead of the general market, with the launch this week, OsoLean is now available to us all.
